At her last court date in July, Carly Young was ordered to appear in person today in Welland for sentencing in her Provincial Offences court trial for the killing of her dog Dakota on July 30, 2024 in Niagara Falls.
Like throughout the proceedings she and her husband Christopher just flipped the bird to the Court – a no show.
And if I am to be perfectly honest….right now…I want to flip the bird to the Court. I have lost all respect.
I want to raise concerns about how court was overseen. I was present in the courtroom and I want to raise concerns as to fairness and the administration of justice.
She put forth that:
- the evidence showed that Carly Young exhibited no remorse
- Carly admitted putting the muzzle on Dakota
- Dakota experienced extreme distress and died a horrific death
- Dakota’s death was 100% avoidable
- Carly Young submitted no medical documentation to substantiate her claims of mental disability and diminished responsibility
- The Young’s have no financial ability to pay a fine
- Carly Young was cooperative throughout – except the multiple no shows, and refusals to appear in person
The sentencing guidelines for this conviction was:
- A mandatory minimum fine of $25,000 when Causing Distress or Permitting Distress results in the animals death
- Up to $130,000 fine and up to 2 yrs in jail or both for the MAJOR offence conviction
- Up To $75,000 fine and 6 months in in jail or both for the MINOR offence conviction
The Crown had asked for $25,000 fine, 6 months in jail and a lifetime ban on pet ownership
Despite this, the Justice sentenced Carly Young to a $7,000 fine, ZERO jail time and life ban on pet ownership and 2 years probation.
She concedes that Carly Young has no ability to pay this fine since both her and her husband are on disability and have no assets or savings. Knowing this, she chose no jail time – resulting in essence – no penality.
This sentence is a slap in the face, with no deterrence at all – none!
Animal Welfare legislation, enforcement and justice in Ontario is an embarrassment.
Provincial Animal Welfare Services failed to bring the evidence to the Niagara Regional Police (NRP) to be investigated as a crime under Canada Criminal Code 445.1
When advocates pushed and pushed NRP to open an investigation, they refused to press charges.
Dakota was failed over and over again during her abusive life and in her death.
Shame Ontario!
